Eligibility

The UTV giveaway (the “Promotion”) is open only to the following:

1.    The entrant must be a legally recognized business entity operating within the states of Missouri, Kansas, Iowa or Nebraska at the time of entry;

2.    The entrant must have a valid driver’s license from the aforementioned states;

3.    The entrant must have an active cfm Distributors, Inc. account associated with the business entity;

4.    All entrant’s cfm account must be in good standing at the time of entry and throughout the duration of the sweepstakes; and

5.    The entrant must have at least one individual associated with the business entity who possess a valid EPA certification card at the time of entry.

 (“Eligible Entrants”).

Entrants represent and warrant that they are authorized to enter the Promotion on behalf of the business entity and have the authority to accept the prize on behalf of the business entity, should they be selected as the winner.

Employees of cfm Distributors, Inc. and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies and the immediate family members of each are not eligible to win.

The Promotion is subject to all applicable federal, state and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and cfm Distributors, Inc.’s decisions, which are final and binding in all matters related to the Promotion, including but not limited to the administration and operation of the Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein.

Promotional Period

The Promotion will begin on March 15, 2024 at 12:01 a.m. and end on September 25, 2024 at 11:59 p.m. (the “Promotion Period”). 

All entries must be received by cfm Distributors, Inc. by the end of the Promotion Period to be eligible for the drawing.

How to Enter

During the Promotion Period, there are two (2) ways to enter the Promotion:

1.    Purchase of Eligible Products for Entry. Upon the purchase of Eligible Products (as hereinafter defined), Eligible Entrants will automatically receive a specified number of entries into the Promotion, as outlined below. The number of entries awarded is directly proportional to the total amount of money spent on Eligible Products, excluding taxes, shipping, and handling, and any other fees associated with the purchase.

To qualify for entry through the purchase of Eligible Products, transactions must be completed, and payment must be received by cfm Distributors, Inc. during the Promotion Period. Installment payments shall not be included unless the payment is paid in full during the Promotion Period. Purchases made before or after the Promotion Period will not qualify for entry into the sweepstakes.

Products purchased or received through warranty claims or transactions are not considered Eligible Products and do not qualify for entry into the Promotion. Products that are purchased and then returned to cfm Distributors, Inc. or any of the listed vendors will not be considered as purchases for the purpose of this Promotion. Any entries awarded based on the purchase of a product that is subsequently returned will be disqualified and removed from the entry pool for the Promotion.

2.    Mail-in Entry. Eligible Entrants can mail in a postcard addressed to Win a Key to the UTV, c/o Kellie Hill to 1104 Union Ave Kansas City, MO, 64101 once per day for a maximum of ten (10) total entries, including entries received from purchases over the course of the Promotion Period. The mail-in entry shall include the business entity name, cfm Distributors, Inc. customer account number, phone number, email, and the name of the individual representative for the business.

A maximum of ten (10) total entries, including entries received from either the purchase of the Eligible Products or through a no purchase necessary mail-in entry.

Winner Selection

cfm Distributors, Inc. will randomly select five (5) eligible entries (each, a “Potential Winner”). cfm Distributors, Inc. will attempt to contact the Potential Winner(s) in the manner described below. A representative from cfm Distributor’s, Inc.’s accounting firm herein referred to as the "Auditing Representative," to oversee and audit key aspects of the contest process. This Auditing Representative will be present to oversee the drawing of five (5) potential winners from a pool of Eligible Entrants, which shall be conducted by physically pulling names from a hat or similar container, ensuring a fair and random selection process. The representative's role includes verifying the eligibility of entries, overseeing the random drawing to ensure fairness, and ultimately auditing the process to certify its compliance with the contest rules and applicable regulations.

The Potential Winners selected through the random drawing will be invited to participate in a special event ("Event") hosted by cfm Distributors, Inc.at 1104 Union Avenue, Kansas City, Missouri 64101, on October 4, 2024, where they will have the opportunity to select one (1) of five (5) keys provided by the cfm Distributors, Inc. 

The Event will be livestreamed for any Potential Winners that are unable to attend in person. cfm Distributors, Inc. will reimburse the Potential Winners (one authorized individual from the business entity) for mileage at the rate per mile set by the IRS (for 2024, the IRS standard milage rates are 65.5 cents per mile for business) and a one (1)-night stay at a hotel of cfm Distributors, Inc.’s choosing. The mileage must be made from the Potential Winners business location that is in Kansas, Missouri, Iowa, or Nebraska. Additional information will be provided by cfm, Distributors, Inc. prior to the date of the Event.

During the Event, each contestant, in the order in which they were drawn, will choose one key and attempt to start the UTV. The winner of the UTV will be the first contestant who selects the key that successfully starts the UTV.

Winner Contact

cfm Distributors, Inc. will attempt to contact a Potential Winner through a phone call and an email on September 27, 2024. If a Potential Winner cannot be reached during the twenty-four (24) hour period or fails to respond to cfm Distributors, Inc. within twenty-four (24) hours after said message is delivered, such Potential Winner will be disqualified and an alternative Potential Winner will be randomly selected from the remaining Eligible Entrants and contacted. At all times, cfm Distributors, Inc. reserves to right to select an alternate Winner in the event that a Winner is found to have not complied with these Official Rules.

Prize Descriptions; General Prize Terms

Prize Description. 2024 Polaris RZR XP 1000 Premium, VIN # 3NSNEC993RF296526. (the “Prize”).

General Prize Term. The odds of winning the Prize will depend on the number of entries cfm Distributors, Inc. has received by the end of the Promotion Period, and will decrease as more entries are received. The right to receive a Prize is non-transferable and non-assignable. No cash redemption of the Prize is permitted.

THE PRIZE WINNER IS SOLELY RESPONSIBLE FOR THE PAYMENT OF ANY AND ALL APPLICABLE STATE SALES TAX, DELIVERY FEES, TITLE AND REGISTRATION FEES, AND ANY OTHER CHARGES PRIOR TO BEING ENTITLED TO RECEIVE THE UTV IN THIS CONTEST. Failure to do so within 30 days of the date that the Winner is advised that the UTV is ready for pick-up may result in forfeiture of this portion of the Prize, in cfm Distributors, Inc.’s sole discretion. A form 1099 may be issued based on the value of the Prize as required by law. Winner may be required to execute and return any required affidavit of eligibility and/or liability/publicity release and must provide proof of identify and age to accept the Prize.

Winner shall be solely responsible for obtaining and payment of any federal or state required registration, inspection, insurance coverage, and taxes for the Prize. Additional information regarding the warranty, pick-up/delivery, and additional information will be provided in a phone call and an email to the Winner within three weeks of winning. Winner will be required to complete all relevant transfer documents for the Prize during regular business hours. cfm Distributors, Inc. will not be responsible in any manner of any warranties, representations, or guarantees, express or implied, in fact or law, relating to such UTV, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer’s warranty that may apply to the vehicle.

By participating in the Promotion, each entrant agrees to release and hold harmless cfm Distributors, Inc. and its affiliates (“Released Parties”) from and against any and all claims, injuries, damages or losses that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any Prize(s) awarded. Each entrant (irrespective of whether or not such entrant wins a Prize), grants to cfm Distributors, Inc. an independent, royalty-free, perpetual, irrevocable, fully transferrable, non-exclusive, worldwide right (but not obligation) and license to publicize and use such entrant’s name, address (city and state of residence), photograph, voice and/or other likeness and Prize information in any and all media now known or hereafter devised, without additional compensation or consideration, notification or permission, unless prohibited by law.

Failure by cfm Distributors, Inc.to enforce any term of these Official Rules shall not constitute a waiver of that provision. cfm Distributors, Inc. (a) does not make any warranty, guaranty or representation of any kind concerning the Promotion or a Prize and (b) to the extent permitted by law, disclaim any and all express and implied warranties (including, without limitation, quality, merchantability and fitness for a particular purpose) relating to the Promotion and the Prize(s). cfm Distributors, Inc. is not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, through e-mail or mail. Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. The Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet service provider, website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prize or in any Promotion-related materials. cfm Distributors, Inc. is also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. The Released Parties are not responsible for injury or damage to entrants’ or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the website. cfm Distributors, Inc. reserves the right in its sole discretion to disqualify any person (including an entrant) cfm Distributors, Inc. suspects or finds: (i) to have tampered with the entry/selection process or the operation of Promotion; (ii) to be acting in a disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring cfm Distributors, Inc. or cfm Distributors, Inc. into disgrace; (iv) to have provided inaccurate information on any legal documents submitted in connection with Promotion; or (v) to be acting in violation of these Official Rules. cfm Distributors, Inc. reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. cfm Distributors, Inc. reserves the right to cancel or modify the Promotion if fraud or other difficulties compromise the integrity of the Promotion, as determined by cfm Distributors, Inc. in its sole discretion. cfm Distributors, Inc. reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Promotion. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE PROMOTION AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.

Indemnity; Disputes. By participating in the Promotion, all entrants agree to indemnify and hold harmless each of the Released Parties from any and all liability arising out of or relating in any way to the entrant’s participation in the Promotion. Except where prohibited by law, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or the Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State and Federal courts located in the County of Jackson County, State of Missouri; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH PARTICIPATING THIS PROMOTION AND/OR RECEIVING A PRIZE, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an entrant and cfm Distributors, Inc. in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Missouri without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri. If any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable. In any event, the unenforceability or invalidity of any provision will not affect any other provision of these Official Rules, and these Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have.
